We thank you for your support of SmartNet and Sovenix, and we hope that you find our services to be of value to you, your friends and colleagues, and your business.  This Acceptable Use Policy (AUP) explains your rights and responsibilities in using our Internet-based hosting and access services.  You should read this document carefully before using any of our services, as the use of such services implies your consent to be bound by its terms and conditions.

The intent of this policy is not to unnecessarily impose limits or restrict your use of our services, but to ensure the safe and fair use of our services, and the services of others connected via the Internet, by all others.

Malicious Intent
If you access the Internet through SmartNet DSL or SmartNet Dial-Up, if you access a Linux shell through one of our shared servers, or through a Linux virtual server assigned to you, or through your own colocated server at our facility, or if you host a web site or email on any of our servers or servers connected to our network, you agree that you will not use or develop any software that targets another user or computer for malicious purposes, or which creates a denial-of-service (DOS) attack against any other computer or user on our network or any network connected to the Internet.  You agree that you will not use or develop software that attempts to gain unauthorized access to the private and confidential information of any other user, business or computer or computer network.  Sovenix reserves the right to terminate or suspend any of your services if we deem, at our sole discretion, that you are engaging in such activities, and you agree to hold us harmless from any consequences of taking such action.

Unsolicited Bulk Email
You may not, under any circumstances, use your SmartNet DSL, SmartNet Dial-up or any of our servers to send unsolicited bulk email (spam).  If you do send bulk email to affinity groups of people, potential or existing customers, colleagues or others, you agree to provide us proof of your opt-in policy and proof of acceptance of the recipients of your messages when requested and without unnecessary delay.  We reserve the right to terminate or suspend your service with us as a result of violation of this policy.

Content
Sovenix, Inc. reserves the right to terminate or suspend any of your services if it deems that the content you are providing via web sites or email is malicious, inflammatory, unsolicited, libelous or otherwise does not meet standards for decency.  You may also not use the intellectual property of others without written consent.  You agree that Sovenix shall have the final word in all such issues and will be held harmless from any consequences as a result of terminating or suspending your service for this reason.

Court Order
You agree to hold Sovenix, Inc. and SmartNet Internet Services harmless from any action we are obligated to take as a result of a court order or official warrant.

Third Party Complaints
You agree to hold Sovenix, Inc. and SmartNet Internet Services harmless from any claims made by third parties as a result of actions taken by you, content created by you, sent by you or posted to your web site, or for any other reason related to your use of our services.  You also agree to hold us harmless for any consequences related to the termination or suspension of your service as a result of such complaints, and that we may use our own discretion in deciding whether such complaints are valid.
